Agreement to Terms

These Terms of Service govern all services provided by Creative Marketing AI. By purchasing services or checking the acceptance box at checkout, you agree to be bound by these Terms.

Services Overview

Creative Marketing AI provides:

• Website design and redevelopment
• Website optimization and SEO improvements
• Social media content and marketing services
• Hosting and infrastructure management
• Content creation, including text, images, and video
• Specific scope, pricing, and deliverables are defined at the time of purchase.

Website Redesign Pricing and Estimate Acceptance

Website redesign services are priced based on a dynamic AI-generated evaluation.

Pricing is determined using Creative Marketing AI proprietary estimation systems.

Client is provided with a project estimate and a downloadable PDF report outlining page structure and scope.

The estimate and PDF define the agreed scope and pricing. By purchasing, Client accepts the estimate and PDF and agrees to the total project price.

All estimates are valid for 14 days from the date generated. Pricing may change after this period.

The estimate and downloadable PDF take precedence over any general service descriptions.

If additional complexity or requirements are discovered, pricing may be adjusted with Client approval. Work outside the estimate is treated as a change request.

Hosting Requirement

• All websites must use Creative Marketing AI hosting.
• Hosting is $99/month or $999/year, selected at checkout.
• Hosting includes infrastructure, performance, and security.
• Hosting charges start 30 days after signup unless different checkout terms are shown.

Payment Terms

Available payment options may include:

• Full payment upfront
• 50/50 split, with the second payment due in 30 days
• 3-month financing at 18% APR
• 6-month financing at 18% APR
• 12-month financing at 18% APR

Domain Control for Financing Plans

• Client transfers administrative control of the domain during the payment term.
• Domain ownership remains with Client.
• Control is returned after final payment.
• If payments are missed, Company may retain domain control until the account is resolved.

Recurring Services

Recurring services include SEO, social media, content creation, and marketing retainers. Exact monthly package recommendations and pricing may be shown after the audit because scope depends on niche, service area, competition, rankings, and website condition.

• Recurring services are billed monthly.
• Client may cancel before the next billing cycle.
• Upgrades are allowed.
• Downgrades may be restricted during an active billing cycle.
• The AI receptionist plan includes 2,000 talk-minutes per month; additional minutes are billed at $0.20 per minute.

SMS/Text Messaging Program

Program: Creative Marketing AI sends transactional text messages — appointment reminders, missed-call follow-ups, and requested service information — to customers and prospects who opt in by phone, by web form, or by contacting us. Consent to receive texts is not a condition of any purchase.

Message frequency varies. Message and data rates may apply.

For help, reply HELP, or contact [email protected] or (618) 266-3208. To opt out, reply STOP at any time; you will receive a confirmation and no further messages will be sent.

We do not sell or share mobile phone numbers or SMS consent with third parties for their own marketing. See the Privacy Policy for how mobile information is handled.

Onboarding and DNS Setup

Client agrees to provide content, access, and business information and to complete domain and DNS steps as requested.

Company configures Cloudflare and preserves email records where possible. Client must update nameservers as instructed.

Project Timelines

• Website rebuilds are planned around a 30-day launch window when required information, assets, DNS steps, and approvals are provided on time.
• Timelines are estimates.
• Delays may occur due to Client responsiveness, access delays, DNS delays, approval delays, missing assets, or change requests.
• Billing cycles are independent of delivery timelines.

Cancellation and Refund Policy

Client may request a full refund within 72 hours of purchase.

After 72 hours, refunds are case-by-case, may be partial based on work completed, and are not guaranteed.

Suspension for Non-Payment

If payment is missed or disputed, Company may:

• Pause services
• Restrict access
• Withhold deliverables
• Retain domain control when applicable

Ownership of Work

Ownership transfers to Client after full payment. Until then, Company retains ownership of the work. Company may use completed work in its portfolio.

Client Responsibilities

Client agrees to provide accurate content, respond promptly, maintain access, and review submitted materials.

All content is submitted for Client review. Client is responsible for approval and accuracy. Company is not liable for approved content errors.

No Guarantees

Company does not guarantee specific rankings, traffic, leads, revenue, or business outcomes.

Limitation of Liability

Company liability is limited to the amount paid by Client for the applicable services. Company is not liable for indirect, incidental, special, consequential, or punitive damages.

Termination

Company may terminate services for breach of these Terms. Client remains responsible for completed work and amounts due.

Infrastructure Disclaimer

Services rely on Company systems, hosting, integrations, and third-party providers. Migration may require additional work. Reasonable access to content is provided upon termination where commercially practical and where all outstanding balances are resolved.

Acceptance

By completing checkout, Client agrees to all Terms.
